Terms and Conditions

---

Effective date: September 5, 2026

These Terms and Conditions ("Terms") govern your use of golfbagponcho.com (the "Site") and your purchase of products from Golf Bag Poncho LLC ("Golf Bag Poncho," "we," "us," or "our"). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

Products and pricing

We sell the Golf Bag Poncho, a waterproof cover designed to fit over a golf bag. Product descriptions, images, and specifications on the Site are provided as accurately as we can, but minor variations in color, material, or fit may occur. All prices are listed in U.S. dollars and may change without notice. We reserve the right to correct pricing or product errors, including after an order has been placed; if that happens, we will contact you and give you the option to cancel.

Orders and payment

When you place an order, you are making an offer to purchase. We may accept or decline any order, including for suspected fraud, product unavailability, or errors in pricing or product information. Your order is confirmed when we send a confirmation email. Payment is due in full at checkout and is processed by our third-party payment processor. By providing a payment method, you confirm that you are authorized to use it.

Pre-orders

Items marked as pre-order are not yet in stock. Your payment method is charged in full at checkout, and your order ships when the first production run arrives, currently estimated for January 2027. Estimated ship dates are estimates, not guarantees. If the date changes, we will email you and you may cancel for a full refund. You may cancel a pre-order for a full refund at any time before it ships by emailing noah@golfbagponcho.com with your order number.

Shipping

We currently ship within the United States only. Shipping costs and estimated delivery windows are shown at checkout. We will email you tracking information when your order ships. Delivery estimates are not guaranteed, and we are not responsible for carrier delays, incorrect addresses provided at checkout, or packages marked as delivered by the carrier. Risk of loss passes to you when the package is delivered to the carrier.

Returns and refunds

If you are not satisfied with your purchase, you may return it within 30 days of delivery, provided the product is unused, in its original condition, and in its original packaging. To start a return, email noah@golfbagponcho.com with your order number. You are responsible for return shipping costs unless the product arrived damaged or defective. Once we receive and inspect the returned item, we will refund the purchase price to your original payment method. Original shipping charges are non-refundable. Products that show signs of use, dirt, or damage may be refused or subject to a partial refund.

If your product arrives damaged or defective, contact us within 7 days of delivery with photos and we will send a replacement or issue a full refund, including shipping.

Use of the product

The Golf Bag Poncho is designed to help keep your golf bag and its contents dry in wet conditions. It is not a guarantee against water intrusion in all conditions, and it does not protect against theft, impact, or other hazards. You are responsible for securing the cover properly and for the contents of your bag. To the fullest extent permitted by law, we are not liable for damage to golf clubs, electronics, or other items stored in a bag while using the product.

Intellectual property

The Golf Bag Poncho name, logo, product design, and all content on the Site (text, images, video, and graphics) are owned by Golf Bag Poncho LLC or used with permission and are protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site or our products without our written permission.

You agree not to use the Site for any unlawful purpose, to interfere with its operation or security, to attempt to access accounts or data that are not yours, or to submit false or misleading information, including in orders or through the contact form.

Disclaimer of warranties

Except as expressly stated in these Terms, the Site and our products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

Limitation of liability

To the fullest extent permitted by law, Golf Bag Poncho LLC and its members, officers, and employees will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or our products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.

Indemnification

You agree to indemnify and hold harmless Golf Bag Poncho LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site or our products or your violation of these Terms.

Governing law and disputes

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute arising from these Terms, the Site, or your purchase will be resolved in the state or federal courts located in New York, and you consent to their jurisdiction. Before filing any claim, you agree to contact us first at noah@golfbagponcho.com so we can try to resolve the issue informally.
